The general terms and conditions as mentioned below apply to all agreements that you conclude with Triple D Innovations, hereinafter referred to as TDI, whether it concerns the delivery of articles or the provision of services.

By ordering you indicate that you agree with the general terms and conditions of delivery.

1. DELIVERY & DELIVERY COSTS
TDI delivers the systems with DHL as long as they are in stock. The delivery time of the systems is generally 2-3 weeks from the order date, if in stock. If you receive systems and/or parts that you have not ordered, you must inform TDI as soon as possible. Or within a week after delivery at max. Any inaccuracies in the information provided to you by TDI must be reported to TDI immediately. This also applies to any changes or inaccuracies in your data that you have provided to TDI.

You can choose to pick up the ordered items after confirmation by TDI.

In all cases there are extra delivery costs.
Click here for an indicative overview. In practice, relatively small changes can occur.
There are no delivery costs when picking up the order.

2. PRICES AND PAYMENT METHODS
The prices at the moment of ordering a system or component apply.
All prices include statutory VAT.
Prices are exclusive delivery charge.
The articles are paid per Ideal, Credit card, Paypal and Apple pay

3. RIGHT TO EXCHANGE AND RETURN
All items purchased in the TDI web shop can be returned to us without giving reasons, but within 30 working days after receipt of the items.

However, you should bear in mind that in the event of an exchange or return, the delivered parts and/or systems should have been used as a check for fit and that the items must be returned with the original labels and packaging without any damage.
If a decrease in value occurs because the items have been used in violation of the above provisions, we reserve the right to demand a corresponding and reasonable compensation from you.
After the 30-day period, you can no longer return your purchase without a reason. You must demonstrate that you have exercised your right of return in a timely manner. The amount paid will be refunded to your bank account within 10 working days if returned or canceled correctly.
Consequences of return
In the event of a decrease in the value of an item, TDI can demand compensation from you. This does not apply if the depreciation of an item can only be attributed to fitting and/or checking the item as would have been possible in a shop.

4. REJECT ORDER
TDI is free not to accept orders via the web shop. This choice lies entirely with TDI and it does not have to motivate this. If TDI does not accept an order via the web shop, TDI will inform you if desired.

5. RIGHT OF WITHDRAWAL
You have the right to withdraw from the contract within a period of 14 days without giving reasons. The withdrawal period expires 14 days after the day on which you or a third party designated by you, who is not the carrier, acquires physical possession of the good. To exercise the right of withdrawal, you must inform us, TDI, of your decision to withdraw from the contract by an unequivocal statement. You can use the attached model withdrawal form for this, but you are not obliged to do so.

To comply with the withdrawal period, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the withdrawal
If you revoke the agreement, you will receive all payments you have made up to that point, including delivery costs (with the exception of any additional costs resulting from your choice of a special non standard systems and /or a delivery method other than the cheapest standard delivery offered by us) immediately and in any event no later than 14 days after we have been informed of your decision to withdraw from the contract. We will pay you back using the same means of payment with which you made the original transaction, unless you have expressly agreed otherwise; in any event, you will not be charged any fees for such reimbursement.
We may withhold reimbursement until we have received the goods back or you have provided evidence that you have sent back the goods, whichever is the earliest. You must return or hand over the goods to us without delay, but in any case no later than 14 days after the day on which you communicated your decision to withdraw from the contract. You are on time if you return the goods before the period of 14 days has expired. The direct costs of the return shipment are for your account. You are only liable for any diminished value of the goods resulting from the use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Excluded from the right of withdrawal is a consumer purchase that pertains to the delivery of:
• products manufactured according to consumer specifications, which are not prefabricated and
which are manufactured on the basis of an individual choice or decision of the consumer, or which
are clearly intended for a specific person.
• products that of which the waterproof seals have been broken after wrong use.
• products that are irrevocably mixed with other items after delivery due to their nature.

6. PROTECTION AND USE OF PERSONAL DATA & CREDITORS
The data required for the processing of your order will be stored and possibly passed on to companies affiliated with us or companies that provide part of our services in the context of processing the order.
TDI reserves the right to carry out an analysis of the data provided by you and to offer an alternative payment method based on the information obtained. No correspondence can be entered into about any decisions and conclusions.
Naturally, all your personal data will be treated strictly confidentially and we will strictly observe the legal rules regarding the protection of personal data and privacy. TDI will not sell your personal information to third parties.
In cases where personal data is provided by us to third parties, they are not entitled to use this data for any purpose other than the performance of their task. The third parties with whom TDI works are bound by TDI’s terms and conditions, which guarantee your privacy.

7. WARRANTY
Unless expressly agreed otherwise, the Dutch statutory warranty provisions apply.

Not covered by warranty;

– normal cracks and wear (scratches, dents, fading, wear and/or wear of sealing rubbers or O-rings)
– improper handling, use, storage, maintenance or care
– incorrect activation of the Power switch (not used on LIPO position)
– incorrect installation and use of unsuitable replacement parts
– accidents, impact, misuse, unauthorized repairs or modifications,
– prolonged contact and use with or in water/seawater at depths > 1 meter
– damage caused by using an already damaged system.
– damage caused by use in the rental of a lending base or education.
– prolonged heat or excessive exposure to sunlight (temperatures above 60°C)
– prolonged cold or excessive exposure to frost (temperatures below 4 degrees Celsius)
– damage to custom systems that have been built differently than recommended at the request of
the customer.

8. LIABILITY
As is the case with any electrically operated system, misuse is possible, which can lead to dangerous and/or harmful situations.
TDI accepts no liability towards you for any damage other than in the event that its liability insurance covers the damage AND insofar as the insurer pays out where applicable. Apart from the cases referred to above, liability is always limited to a maximum of the amount of the purchase price of the relevant item(s). Under no circumstances will the compensation referred to in this paragraph amount to more than € 1,000.

TDI is never liable for damage or consequential damage.

9. FORCE MAJEURE
In a situation of force majeure, TDI’s obligations are suspended. If the period in which the force majeure occurs is longer than two months, both you and TDI have the right to dissolve the agreement without any obligation to pay compensation. Force majeure includes strikes, illness among staff, disruptions in transport and import/export bans, regardless of whether this occurs at TDI or at TDI’s suppliers.

10. ODR PLATFORM
The European platform for online dispute resolution (so-called ODR platform) is made available by the European Commission to make online shopping safer and fairer for consumers and entrepreneurs. The European Commission provides a platform for online dispute resolution for consumers, which you can find at
http://ec.europa.eu/consumers/odr/.
We voluntarily participate in a dispute resolution procedure.

11. RESERVATIONS
Sometimes there may be errors on the website. These errors may relate to the pictures, films, texts, descriptions, prices, etc. TDI can at all times evade its delivery obligation if the customer can reasonably know that it concerns an error or mistake. TDI will eventually be able to decide for itself when this situation applies.

12. PRIVACY

The third parties with whom TDI works are bound by the terms and conditions of TDI, in which your privacy is guaranteed.
